TERMS:

AS IS – WHERE–IS, in the condition at day of sale, no warranties expressed or implied of any kind. Any personal property to convey with unit at no value.

Earnest Money Deposit REQUIRED — $10,000.00 in form of on-bank check, payable to successful high bidder, to be endorsed over to Baldwin Legal Title LLC on day of sale. Closing to occur as soon as Baldwin Legal Title can prepare a Title commitment and have all documentation cleared. Financing is not a consideration for closing of the transaction. Failure to close on the part of the Purchaser is automatic forfeiture of EMD and such escrowed amount shall be given over to auctioneer immediately after breach of closing.

Seller to pay for Deed and Owner’s Title Policy in addition to calculated proration of Property Taxes for the current year only. All other closing expenses shall be borne by the Purchaser.

A ten percent Buyer’s Premium (10%) will be charged to all successful bidders at this sale.
All personal property sold will be sold for cash, good check, with credit cards accepted. Check out will be arranged through the proprietor of E. T. Antiques. All hand carried items are the responsibility of purchaser. Payment required prior to checkout.

All titled motor vehicles sold will be sold as follows:
10% NON-REFUNDABLE deposit will be collected at sale from the successful, highest bidder, the remaining 90% of the purchase price will be required in either cash or Bank Check/Money Order payable to Consignor/Seller (such information will be provided at sale to successful bidder). Successful bidder and consignor will meet at a pre-agreed upon date and time (within 48 hours of sale) to meet at the Foley, AL satellite Courthouse and exchange payment for title in presence of the official or the Title Clerk, or at such other date and time as is acceptable to the parties and auctioneer.
